KitchenAirs (operated by MARATHON ASSETS LLC) respects the intellectual property rights of others and responds to claims of copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA) of 1998.<\/p>\n\n\n\n

This policy describes the information that should be present in a notification of copyright infringement and provides contact information for KitchenAirs\u2019s Designated Agent.<\/p>\n\n\n\n

  4. Information reasonably sufficient to permit us to contact the complaining party<\/strong>, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.<\/li>\n\n\n\n
  5. A statement that the complaining party has a good faith belief<\/strong> that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.<\/li>\n\n\n\n
  6. A statement that the information in the notification is accurate, and under penalty of perjury<\/strong>, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.<\/li>\n<\/ol>\n\n\n\n

    2. Counter-Notification<\/h3>\n\n\n\n

    If you believe that your material has been removed or disabled by mistake or misidentification, you may file a counter-notification with our Designated Agent.<\/p>\n\n\n\n

    To be effective, your Counter-Notification must include substantially the following:<\/p>\n\n\n\n

    1. Your physical or electronic signature.<\/strong><\/li>\n\n\n\n
    2. Identification of the material that has been removed<\/strong> or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.<\/li>\n\n\n\n
    3. A statement under penalty of perjury<\/strong> that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.<\/li>\n\n\n\n
    4. Your name, address, and telephone number<\/strong>, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which KitchenAirs may be found, and that you will accept service of process from the person who provided the original notification of the alleged infringement.<\/li>\n<\/ol>\n\n\n\n
